OhaBloom Terms of Use and Sale
This is a translation offered for convenience. The French version prevails.
The mandatory rights of the consumer cannot be set aside by these terms.
1. Who we are
OhaBloom (ohabloom.com) is operated by 9489-9697 Québec inc., doing business as Souvenirs OhaBloom, in Quebec (Canada).

2. Acceptance, language and version
By creating an account, accepting an invitation or paying, you accept these terms and the privacy notice. Before any payment, you can check your order, correct it or cancel it. The payment screen states: « By paying, you accept the terms of service and sale » with a link to the version in force, whose number is kept with your purchase.
French prevails. A version in another language may be offered for convenience.
3. Accounts and invited people
The account holder is an adult able to enter into a contract. Children do not have an account. You give accurate information, you protect your access and you notify us of any unauthorized access. Each invited adult accepts these terms for themselves. You are responsible for the people you invite and the powers you give them.
4. Your content and your permissions
You keep your rights to your content (texts, photos, voices, videos, dates, people, relationships).
You grant us, for as long as we keep it, a worldwide, non-exclusive and free licence, which we may extend to our providers, to host, copy, back up, transcribe, analyse, summarize, organize, adapt, lay out, display, translate, print, deliver and personalize the service, your books, your suggestions and your questions, including with automated tools and artificial intelligence, as the privacy notice explains.
This licence does not include advertising, or the training of general artificial intelligence models, unless you authorize it separately, which you can withdraw at any time.
You confirm that you have the right to entrust this content to us, including the information, voice and image of the children over whom you have authority and of the other people who appear in it, and you agree not to upload content that is illegal, misleading, abusive or that infringes the rights of others. A relative who adds a memory likewise confirms that they have the right to do so. A person mentioned in a memory, a contributor or a gift buyer gets no access to the family space.
5. The service
OhaBloom lets you, among other things, create and keep private memories, add photos, voices and videos, link people, find your memories, receive questions, invite relatives, share a montage, prepare and order a bound book, export and delete.
OhaBloom is not a guaranteed archiving service or a backup of your devices. We may change features for security, to comply with the law or to improve the service, without removing a mandatory right or a paid promise.
6. Artificial intelligence
Some features use artificial intelligence, for example to transcribe, understand your photos, suggest questions or facts. Their results are proposals: they can be wrong, you check them and you can correct them. Nothing goes into your book without your confirmation, and artificial intelligence makes no decision for you.
7. Offer, price and taxes
The launch offer includes 12 months of the OhaBloom service for 159.97 CAD before taxes, a 30-day satisfaction guarantee (section 9) and a bound book covering the first 80 pages; each additional page costs 0.85 CAD before taxes. The total, applicable taxes, any delivery and the currency are shown before payment. No amount higher than the one shown is charged.
8. Payment, renewal and cancellation
Our payment provider processes the payment and the full card data; OhaBloom does not keep them. You receive a copy of your contract and your invoice in French.
The subscription renews automatically every year, at the price in force, plus taxes. A reminder is sent to you before each renewal. You can cancel at any time, online, with the « Cancel my subscription » button in your account; you keep access until the end of the paid period. We notify you of any price change before it affects you.
9. 30-day satisfaction guarantee
Within 30 days of the activation of your paid access (for a gift, from the date of purchase, even if it is not yet activated), write to support and you are refunded in full, without having to give a reason. The included book is not sent to print before the end of these 30 days or during a refund request. After these 30 days, no refund is granted, unless the law requires it. This guarantee is in addition to your legal rights and does not replace them.
10. Bound book
Before printing, you approve the final file, the address and the applicable fees. The book is printed from the approved file, by a partner printer, and delivered free of charge in Canada and the United States (maximum 200 pages). The printed QR codes lead to content you chose to link.
If the book arrives damaged, has a printing defect or does not match the approved file, write to us promptly with a photo. We reprint, replace or refund, without limiting your legal remedies. We may refuse to print illegal content.
11. Gifts
A person can give OhaBloom as a gift. The buyer remains the holder of the 30-day guarantee, which runs from the date of purchase, and of its cancellation; the person who receives the gift accepts these terms for themselves by activating it. Giving or paying gives no access to the family's content.
12. Communications
We write to you about your account, your orders and security, which is separate from marketing. Marketing by email or text message requires your separate consent and can be withdrawn at any time.
13. Suspension, end of service and non-renewal
We may limit or suspend an access to protect a person or the service, respond to an incident, comply with the law or remedy a serious breach, explaining the reason when possible. You can stop using the service and ask for the deletion of your account at any time.
If you do not renew your subscription, your access becomes read-only at the end of the last paid period.
- The memories in your book (those of an approved page or of a printed version) remain viewable as long as OhaBloom exists, and you can export them at any time.
- The other memories are deleted 12 months after read-only access begins. This period may be revised for the future.
- An email reminder is sent to you 90 days before the deletion, with how to export.
- If you pay again before the announced deletion date, everything is kept.
- You can ask for everything to be erased, including the memories in your book, at any time.
- Proof of purchase is kept as long as the law requires, without your family's content.
If OhaBloom had to end a service, we would seek to give you reasonable notice and the opportunity to export your data, subject to security, the law and feasibility.
14. Legal warranties and liability
We take reasonable means to provide the service, protect your data and fix problems; no online service is 100% available or secure. These terms do not limit the legal warranties or the liability the law imposes on us toward a consumer. We are not liable for a delay caused by an unforeseeable and irresistible event beyond our control, such as a major outage of an infrastructure provider, and we resume the service as soon as possible.
Nothing in these terms prevents you from publishing your opinion about OhaBloom.
15. Governing law
These terms are governed by the laws applicable in Quebec and in Canada, without depriving you of the mandatory protections of your place of residence. Before taking action, you can write to us to look for a solution; this does not suspend any legal deadline.
16. Changes
The version and effective date are shown. We notify you of an important change before it applies, as the law requires. If a clause is invalid, the others remain. Not exercising a right right away is not waiving it.
